The operator and owner of personal data processed in connection with the operation of the merrell.in.ua website is Aviation Metals of North Carolina, Inc., registration number EIN 56-1341457, registered at 1810 W Pointe Dr, Ste D, Charlotte, NC. This legal entity independently determines the purposes and methods of processing the personal data of website users.

The processing of personal data is carried out on the basis of the Law of Ukraine “On the Protection of Personal Data” dated 01.06.2010 No. 2297-VI.

Categories of personal data that are collected

The following categories of personal data may be processed within the framework of the website’s operation:

  • last name, first name, patronymic of the buyer or recipient of the goods;
  • phone number;
  • email address;
  • delivery address, city, branch or post office number;
  • composition, number, cost and order history;
  • fiscal receipt details and order payment status;
  • correspondence and contacting support service;
  • details of applications for exchange, return (more details on the Return and Exchange page) and warranty service (more details on the Warranty page);
  • IBAN or payment card number voluntarily provided by the buyer for a refund or compensation;
  • IP address, browser type, device, operating system and source of referral to the site;
  • cookies, session IDs, and Google Ads advertising IDs.

Sources of data

Personal data comes from the following sources:

  • data that the buyer independently enters when placing an order on the website;
  • data provided by the buyer by telephone or email;
  • data on applications for exchange, return or warranty claims;
  • technical data automatically recorded by the site when viewing pages;
  • information from the carrier OOO Nova Poshta;
  • information from the payment operator NovaPay LLC in connection with the processing of cash on delivery;
  • information from the fiscalization service when generating a fiscal receipt;
  • data collected and processed by Google Ads.

Purposes of data processing

Personal data is processed for the purposes of order processing and identification, order completion and delivery, payment confirmation, generating and sending a fiscal receipt, informing the buyer of the order status, processing requests for exchanges, returns, warranty service, and compensation, ensuring the operation of the customer support service, preventing fraud, ensuring website security, and maintaining financial and internal accounting.

Grounds for data processing

Personal data is processed for the following reasons: to fulfill an order and fulfill the seller's contractual obligations to the buyer; to comply with mandatory legal requirements regarding record-keeping and document storage; and to ensure website security and prevent abuse.

Payment by payment cards

Payment for orders is made exclusively upon receipt of the goods—cash on delivery through Nova Poshta LLC, either by card (Apple Pay, Google Pay) or in cash. When placing and paying for an order, the website does not request or receive any payment card details—not the card number, expiration date, CVV/CVC code, PIN code, banking app password, or SMS confirmation code.

Additionally, after a purchase, as part of the agreed-upon refund or compensation process, the buyer may voluntarily provide the IBAN or card number for crediting. This information is provided by the buyer in one of two ways: by written request included in the package containing the item being returned to the seller, or by request sent to the seller's email address. Forms for submitting data directly on the website are not used.

Transfer of data to third parties

Personal data may be transferred to the following categories of recipients, and only to the extent necessary for the purposes specified below:

  • to the carrier OOO Nova Poshta – for delivery and return of goods;
  • to the payment operator NovaPay LLC – for receiving, processing and transferring payments in the case of payment upon receipt of goods;
  • fiscalization service - for generating and sending a fiscal receipt;
  • telephony service – customer phone numbers and recordings of telephone conversations;
  • Google Ads – for advertising purposes and to evaluate advertising effectiveness;
  • government agencies only if there is a mandatory requirement of law.

The Seller does not sell or lease personal data of buyers to third parties; data is transferred to the above-mentioned recipients only to the extent necessary to perform the specific function described in this Policy.

Google Ads and advertising tools

This website uses Google Ads, a tool used to measure advertising effectiveness and evaluate conversions. Google may receive cookies, the purchaser's IP address, and technical and advertising identifiers. Google Ads conversion tracking may transmit order-related information necessary to record the conversion. However, the purchaser's last name, first name, middle name, phone number, email address, shipping address, IBAN, or credit card number are not included in the URL, page parameters, or standard Google Ads advertising tags.

Cookies

This website uses essential technical cookies required for proper website operation and order processing. Additionally, advertising cookies related to Google Ads are used to measure the effectiveness of advertising.

When first visiting the site, the user is shown a banner informing them that the site uses mandatory technical cookies and allowing them to accept the use of cookies. Cookies can also be managed through browser settings, providing an additional level of control.

Marketing messages

The seller does not send marketing or advertising mailings to buyers.

Data retention period

  • Order data is stored for the period necessary for execution and mandatory accounting;
  • data on applications for exchange, return and warranty claims are retained until the completion of the relevant procedure and the required accounting period;
  • Cookies are stored for the period specified in the settings of the relevant category or service;
  • After the grounds for further storage cease to exist, personal data are deleted or anonymized.

User rights

The user has the right:

  • receive information about how his personal data is processed;
  • access the data stored about him;
  • request correction or updating of inaccurate data;
  • demand the deletion of data if there are no grounds for its subsequent storage;

Requests are processed during business hours from 9:30 AM to 9:30 PM, seven days a week (Kyiv time). A response by email is provided within 3-7 hours of the request, and the seller will identify the applicant based on the information provided in the request.

Data protection

  • The connection to the site is protected by the HTTPS/SSL protocol;
  • only the data necessary for the purposes described in this Policy is collected;
  • Only authorized employees and contracted service providers have access to personal data;
  • organizational and technical measures are applied to protect data from unauthorized access;
  • the seller does not request full payment card details, PIN code, CVV/CVC code, banking application password or SMS confirmation code;
  • Personal data is not transmitted via public URLs.

Cross-border data transfer

Due to the use of the Google Ads advertising tool, personal data may be processed outside of Ukraine. Specifically, order-related information may be transferred as part of Google Ads conversion tracking. However, the purchaser's last name, first name, middle name, phone number, email address, delivery address, IBAN, or card number are not included in the URL, page parameters, or standard Google Ads tags.
